Can you please give me some advice ? My husband passed away a few months ago and I received a lump sum instead of a pension from the army. For personal reasons we were never in a position to treat our kids and always said we would do so if anyone of us passed away. I have drawn cash out and also made a couple of bank transfers to my sons and family and also my husband's parents who are having a tough time at the moment. I have had a letter from DWP saying that they need bank statements and receipts for any money I have spent over £250 from this money. They also said that my benefits could be stopped if I had given the money away!! Without going into personal details my husband had a hard time and we made wills with the fact that we would share any money, however I can only find mine. I have got nothing to hide but if I am not sure what I need to do. Thanks for reading.

I am sorry for your loss.

If you are receiving Income Related benefits such as ESA)IR, Income Support or Pension Credit (there are others), then your capital and savings can effect the money you are receiving.

I'm afraid the DWP are entitled to ask for these receipts and you need to be aware that if they are not satisfied with how you have disposed of the money then you can be classed as still being in receipt of it, which may have an ongoing impact on the money that you receive.

Thank you for your comments. I am on ESA and PIP. I can prove where the money has gone, would I be better getting a letter off my family to say they received the money? I am just unsure what to do.

I'm afraid the issue is not who you gave the money to but whether it was reasonable for you to do so or not, they may decide that you made the payments in order to continue receiving benefits.

If you don't mind answering, how much did you receive?

£16,300. But my husband had problems and we owed family who had continually bailed me out of situations. I paid back what I could and also helped my kids.
