Hi, I am trying to ensure that when I die, my daughter, for whom I am sole carer, will be able to support herself, this means leaving her everything I own in the hope she can cash in and realise enough to buy a tiny flat and live off the residue. She is currently on Contribution based ESA in the Support Group, with very little hope of ever being well enough to work, and has been since she was 16 - will this eventually be subsumed into Universal Credit? And if so would that mean that suddenly she would be means-tested?

Trying to work out the best way to do my Will, to help her to live as independently as possible with paid carers.

Would really appreciate any advice about this.

Also, what happens to someone like her who has spent their life on support benefits - will she get a normal pension at retirement age, and would that then mean that her benefits would stop? It's a long way off but I want to be able to write down for her what she can expect in the future so she has some understanding of the future.

Whilst I appreciate what you are trying to do, this is a time of significant change in the benefit system and information I supply today could be superseded next year.

If she is only receiving Contribution Based ESA, then her assets and savings will not effect her payments.

ESA(CB) does not come under the UC umbrella although she may be migrated to what is called New ESA at some time in the future, this is the same as ESA(CB) but uses more recenet legilsation.

One thing to be aware of, if she is moved out of the SG then her ESA(CB) payments will be
limited to 365 days, if she is eligible for ESA(IR) then they will continue, but this then creates issues with her savings and she would then be migrated to UC.

ESA pays NI Credits which count towards a full State Pension so this should be covered. As to what benefits she might be entitled to at that time, your guess is as good as mine!

Thanks Gordon, that's cleared up some of my queries anyway! I guess it all depends on whether she has to move onto new ESA. I don't think she would be removed from the Support Group, so I guess that means they would take her off CB and force her to be Means Tested - exactly what I have always tried to avoid because of the tortuous paperwork involved.

I have other questions, but I need to take time to think them through - I may well be back asking more inane questions soon!

If she remain in the SG then she will not be "forced" onto a means tested benefit, although she may be entitled to an ESA(IR) top up to her ESA(CB) which would mean that she receives more money,
