Pip renewal medical then money reduced due to lies

Hi ive had my renewal face to face medical, ive got a none canerous brain tumour which is dangerous and after 8/ 1/2 surgery in 2011 all couldn't be removed, this left me deaf in my left ear, no balance nerve and poor mobility and severe depression I also have fibromyalgia, they sealed my tumour off and hoped it wouldn't grow but it has so 6 months ago I had radiotherapy, this is to just try shrink it back, it will not get rid off it and more surgery will be life threatening, my doc wrote a letter saying no change to symptoms/medication/pain/depression and unfortunately this is long term, I was on the higher rate of pip for both after having an assessor coming to me 3 years ago who told absolute lies about me so I was awarded standerd rate so I appealed and went to court and won and git the higher rate bk, nothing has changed and yet again they have reduced me to standard knowing full well ive already won one court appeal 3 years ago, I pleaded with the assessor to tell the truth this time as the last lady told lies and it nearly tipped me over the edge going to court, she asked if the assessor was in court as well, I said no, well how sly was she because its come bk full of lies again, I dont cook or prepare any meals due to black outs and bad balance and I would scold myself, I have ppl bringing me meals but can feed myself most of the time, she said I agreed I cooked using an aid, I get helped in and out of the bath and need help washing my upper body/hair, I only got points for help in and out apparently I can manage once im in !I got ten points for being able to walk with an aid 20 metres but no more that 50, that was fair but then get zero because apparently I can manage and plan a duty alone, I cant go out alone and im in cronic pain I get confused and my medication makes me drowsy, I get freighted, I explained I dont understand certain signs and symbols, she put in her report that I can read and understand complex information ! She said I manage all my bills and agreed to this yet I told her the come out of my bank by dd and some out of my benefits as I get confused and my mum set them up for me , I got zero points again ! My my gave her a list of medication im on and the woman asked if I knew what I take I said im brought my medication by ppl in and out my home at different times I dont and cant manage my own medication as I'd be forgetful or id overdose and I told her I feel suicidal at times, I got zero pints, apparently I manage my own therapy and medication ! More lies, I was in bed in absolute agony, sweating, my left eye kept dropping and drooping due to nerve damage, I kept having to ask my mum questions because im forgetful and she prompts me, the woman said I wont ask you to do any exercises as your in pain, I then get zero points and she said I gave full eye contact apparently I told her all medication im on and when I take it, she said I appeared calm and not anxious ! Yeah right, im on two lots of anti depressants and they have put theres no evidence of any mental health ! Im apealing yet again can someone please help me with my mandatory reconsideration as this is making me fell suicidal again, the higher rate helped me pay fir care coming in and out and now im lost !

Which form did you receive for this renewal, a PIP2 as you did when you originally applied, or an AR1 Review form, this is a shorter form that ask whether your conditions have improved, remained the same or worsened?

If it was a PIP2 then did you complete the form from scratch or copy content from your previous form? I am wondering if you repeated problems from your original claim onto the new form!

Our Submissions PDF in the PIP section has a template letter that you can use to request the MR.

You should contact the DWP for a copy of the assessment report if you have not already done so, I would phone them but again follow up the request in writing. Once you have the assessment report you will have a better understanding of how the DWP Decision Maker has come to their conclusions and will then be able to argue against them.

Whilst I am not saying to ignore the assessment report, you should certainly deal with any issues that it raises, you will only receive a higher award by showing that you meet the criteria for one so I would go back to your form and our PIP Claim guide to make sure that you have shown that you meet the legally defined criteria.

Hi it was an AR1 Review form, I ticked no change on everything and then they wanted a face to face, I today have received the report full of lies, I will of course be fighting this but its so stressful, they have based things on my previous report from 3 years ago stating I manage medication and therapy alone and can cook using an aid yet I cant and I went to court and was awarded more points and went into enhanced rate for both, shes written in her report how I was well dressed and not tired or anxious yet I was in my dressing gown and terrible, it really makes me sad how they treat ppl, she said ive never been admitted to hospital for a blackout yet twice a few years ago I had two real bad episodes where I fell and smashed my head and was hospitalised on one occasion for 3 days, she has written although my tumour is long term I will get a short award due to my fibromyalgia and depression fluctuating ! Nothing has changed and my fibro is agonising as they know, im on anti depressants and have been since my brain op due to the psychological effects its left me with, my depression does not go up and down its always bad, shes written I gave her full eye contact yet my left eye kept dropping and drooping and I had real bad pain in the left hand side of my head, she wrote I seemed fine, I kept having to ask my mum to help me and reming me off things, the assessor said I needed no prompting.

I'm afraid the AR1 is intended to used in conjunction with your previous PIP2, although I am surprised that you received one if the Tribunal Decision was significantly different.

It may help if you include a copy of the Tribunal Decision Notice with your MR, it may help to reset what you should be assessed as being able to do.
