I had a review for PIP in December 2017. The result was a reduction in Daily living activities from enhanced to standard and a reduction from standard mobility to none.
I submittied a MR in January after receiving a copy of the assessment report (same as other lots of errors and blatant lies)
Today I’ve received the MR notice (here lies the problem) it refers to my letter dated 30/01/2018 my letter was dated the 18/01/2018, it goes on to say ‘You have told us that you disagree with the decisions as you used to get DLA and feel you should get the same for PIP. PIP is a different benefit and has different criteria to DLA. Although you may have been entitled to DLA, based on all the evidence, you do not meet the criteria for PIP at the same rate. The health professionals who undertake assessments are professionals that are specially trained in disability assessments. They take into account the history of your conditions, medication, treatment, clinical findings and observations as well as your questionnaire and information you supplied verbally at the assessment. As such the report accurately reflects your usual ability to move around and activities of daily living needs.’

I’ve never been on DLA. I have been in receipt of PIP since 2013.

I phoned DWP to ask if they had gotten me mixed up with someone else, they said a case manager would have a look, correct the letter and sent me out a revised version with the correct information. And that if I still disagreed with the MR decision my next step would be to got to appeal (which I intend to do) but and this I found interesting. The person on the phone also said ‘we advise not to send your appeal yet as the information is incorrect and you will need the revised MR Notice to submit the appeal.

Obviously I’m not going to wait, I’m getting straight on with the appeal using the only information I have.

Has anyone else had anything similar? Or offer any advice?

The letters for PIP are usually pretty good, ESA is another matter, so this is not something that we have seen before, my best guess is that the DM was working on two claimant files and as a result has sent the wrong letter.

Unless you seriously believe that you can overturn the Decision at MR I would carry on to appeal as soon as possible.

I also had the same patronising remark on my letter "The health professionals who undertake assessments are professionals that are specially trained in disability assessments" and there were many mistakes that the original HP made. In my appeal letter I asked them 'why, if my MR was seen by 2 other professionals along with the original HP's report, had no one in Management brought them to task with their cut and pasted report in the wrong sections?' I think it's time they employed Proof readers to go over the HP's reports!
Obviously a lot of cut and pasting goes on at the DWP and isn't checked. If I did that where I work, to the extent that was done on my MR decision, even stating my original assessment was done in another town on the form, I would be disciplined!

I agree I too would be fired!
The HP report was non specific, lots of references to the physical examination which lasted no more than 5 minutes. There were blatant lies. HP stated the assessment started at 10:33 when in fact it started at 10:55 I have proof of a text message I sent to my carer who was waiting for me at 10:50 saying ‘I’m still waiting to go in’
Wish I didn’t have to go through the Tribunal process but its a matter of principle now!

Well the "specially trained" staff had never even heard of my ailment !
Its like banging your head against a brick wall with these people,

My assessor was a nurse and obviously knows more then my consultant urologist !

My appeal letter went off on Monday, Everyone needs to appeal and not accept the DWP decisions !
At least the appeal is independent so if you do fail at appeal at least you you have give it your best shot !
