Just come back from my appeal was created by lynne phillips
Just got back from my appeal only to be told they would not be going ahead with my appeal as they wanted my medical records and that I should seek legal advice because they could grant and take away my benefits.
I was completely surprised by the action and don't understand why. No explanation was given. I did give extra evidence today in the form of letters as I had had an MRI scan and yesterday I had CT scan.
Has anyone experienced this? can anyone enlighten me Im at a loss as to what is happening and feel even more stressed.

To some extent the two issues are separate.

I'm afraid if they have issued a warning about your current award then they are saying that it is at risk if you continue with the appeal, you have the option of withdrawing the appeal.

You should take this warning seriously.

I'm afraid I cannot offer any further advice about whether you should continue with the appeal or not, if you can get face to face advice from a trained advisor they may be able to offer an opinion.

Hi Gorden thank you for getting back to me. I just can not understand why they have done it. My conditions are worse than they used to be. Nothing has change apart from the fact I started work about two years ago. its a job I can manage because it is only term time which gives me the opportunity to recover during holiday time. I also have a very empathetic employer other wise I would not be able to work. its a sitting job
As part of my evidence I did submit a letter that I sent to capita because I was treated so badly at the face to face interview. I complained about lies he told and talking about a previous client before me.
I have a number of conditions from a heart complaint, mental health , breathing problems which are being investigated and rheumatism in the spine. I can not walk more than a few steps unaided.
Back in July I was reassessed and my care component was taken off me but i was able to keep my mobility element of £88 a month.
Is it possible capita just want more information?

This is nothing to do with Capita.

It may be connected to your starting work, but that is just a guess.

ok I understand. if I want to withdraw my appeal can I do that by phone or is there a procedure to follow?
