DLA to PIP

DLA to PIP was created by Drinthehouse
Round about 2012 I was moved from Incapacity benefit to ESA, for which I had to have a medical and I received both care and mobility at the higher rate. The ESA ended in 2014 when I became 65, and it was replaced by the state pension. In the same year I applied for DLA, and again I was awarded the higher level of care and mobility. I obtained the DLA without a further medical, just by returning the completed form. I had to reapply at the end of 2015 for DLA, and this too was awarded for the higher rate in both but this was indefinitely, also without a medical. Do you think I was awarded these two benefits on the strength of the medical I had in 2012, and the evidence I provided at that time to obtain ESA? I ask this because I have recently been invited to apply for PIP, and on the PIP1 form, it asks if you would like to use the evidence from a previous medical(s) therefore, would I be well advised to allow them to use the evidence put forward for the medical I had in 2012? Do you think this will assist my current claim?

Your ESA may have helped with a DLA Mobility award but the criteria are too fundamentally different to have provided any help with the care component.

ESA is closer to PIP and there are some areas of overlap, but even where there are the criteria are still different and if you have not received the benefit since 2014 then there will be issues showing it still being relevant to your current limitations.

I'm not saying that you can't include it but you will need to show in some detail why it is actually relevant.

The DLA information may be slightly more relevant, but is still old and you will again have to show the relevance, also the DLA criteria was what I would call general whereas the PIP is very specific, so it will likely at best be supporting of your claim and you will need more specific evidence if you can get it.
