Writing on behalf of a good mate whose daughter was born 5 years ago at only 24 weeks. As you can imagine, she has a number of health problems, including mobility.
A recent DLA award gave the young lady the lower rate of mobility. The child’s mother requested MandRec on my advice.
A week ago, she received a MandRec reply saying that the original decision stands, so I advised her to go to appeal.
Before she has submitted her appeal, a new MandRec has arrived today now saying she has no mobility award!
Is it usual for two contradictory MandRecs to occur in such a short period of time? And if so, does the one-month appeal window open with the letter she received today?
Strictly speaking the one month applies from the date of the Mandatory Reconsideration Notice so if they were issued with the first MR then this is what you need use.
If you are concerned about the deadline then you can make a Late appeal by explaining why it could not be made within the normal month.
