Hoping you can advise. For a PIP assessment report, where would / should the recorded details of a "typical day" be? For example on my Consultation Report form, there are the following sections: History of Conditions, Current Medication and treatment, Social and occupational history, Functional history, including variability, daily living activities and mobility activities, Observations, Mental State, Musculoskeletal system and / or Central nervous system. Is there usually a separate section where an account of a "typical day" would be, or would it come under one of the above headings, and if so, which one?

At the time of my assessment the HA did not ask me to go into any detail about what a typical day consists of, apart from if I had any hobbies.

I have appealed and in the DWP response following a failed MR, it says "a full functional assessment was completed during the consultation, including medical examination findings, medical opinion and a mental health assessment with Mrs xxxx who gave a full account of a typical day .The Decision Maker considered this when deciding the claim.

This is completely untrue, she definitely did NOT ask this, and I have scrutinised the report and I can't find anything other than under Social and Occupational History it says, about who I live with, then says I am not working as I have been medically retired, that I don't drive, and, under "Hobbies" that I can use a computer and I like watching my son play football. Is this supposed to be a full account of a typical day?

One more point, in the DWP response there is a paragraph which says "In Mrs xxxxxx appeal she indicated she has a progressive disease. The tribunal are asked to establish if this represents deterioration in Mrs xxxxxxxx condition. The tribunal will be aware deterioration occurring afer 15/11/2017, the date the decision was made can't be taken into account in accordance with Social Security Act 1998. Section 12 (8) (b). Should it be established Mrs xxxxx condition has deteriorated, she should be advised to submit a new claim detailing her current needs" However, I stated when I first applied that my condition was a progressive one, so this should not come as a surprise to them, especially given that when I questioned how likely the HA would be familiar with the effects of my condition, given it is quite a rare one and I am the only patient my GP has seen, within his career, with this problem, the response was "The Health Professional is an independent trained disability analyst (I checked her registration and she is a Registered Nurse - Learning Disabilities) and assessed Mrs xxxxxx functional ability based on their knowlege of her medical conditions." I am betting this knowledge is zero! How do I approach this for my appeal submission, I have chosen a paper hearing. Is this a routine thing for them to write? By there own reckoning, because my disease is progressive, I would be re-applying every five minutes. I am very confused by all this and hope somebody can shed a bit of light.

Typical day would be on page 3 (Functional history) and any continuation pages, the emphasis is much more on your ability to complete the activities and any variation rather than a "typical day".

Whilst it can be easier to deal with the issues raised by the assessment report, you will only receive an award by showing that you meet the criteria for one, I'm not saying you should ignore the report but if you don't show where you should score points any things you raised from the report may be moot.

The appeal panel can consider any changes in your conditions that have occurred since the Decision was made, they are legally barred from doing this, the DWP are just reminding them of this.
