I am now preparing to go for appeal and I am going through all your valuable information on here with regards to appeal but I have a couple of questions if that’s ok? can I submit additional information to the appeal board and if I can when can I do this? Also because now the dwp made a decision on my pip to early without awaiting for my additional information they have now sent me a letter requesting I go to appeal but to use the mandortory consideration letters they sent me on the 21st jan ( I sent additional info in so I should have had more time) I now have exceeded the timescale to appeal as I should have till 21st March ? Shall I just explain this to the panel of appeal as to why it looks like my request is late? The dwp have deliberately done this I should have been sent an up to date letter after the decision with my additional information as I had until 23rd Feb to get it into them? Thankyou

The PIP Appeal guide has links to the SSCS1 form that you will need to complete and the Submissions guide has a complete example that you can use to help you fill it in, you do not need to provide detailed reasons at this stage for your request.

The date by which you nee to make an appeal are set by the Mandatory Reconsideration Notice that you should have received, so if this was 21 January then you are stuck with this. You can make a Late appeal by providing your reasons for the delay on the SSCS1, the second MR should be accepted without problem.

Once your appeal is accepted the DWP will prepare their submission to the hearing and send you a copy, whilst you should wait until you receive this to finish and submit your own, you should start to prepare your own case, an increased award will only be made by your showing that you score the extra points for one, so I would start by going back through your PIP2, the assessment report and the PIP Claim guide to see how you might show this is the case.
