Just a quick query..

I was transferred from dla mrc and lrm to nil points with pip.
Following your guides i submitted a MR which i received a reply to today.

I have still been awarded nil points but the reasons given is word for word the same as it was on my orginal award letter apart from one sentence about me asking for the MR by phone.

Is this normal practise?
Feel like they haven't even bothered reading my appeal, which took me a few weeks to put together with help.

I'm now getting ready to submit my appeal but wondering if i'm wasting my time and if the stress and ill effect on my health is really worthit.

The main issue i had with my intial f2f was the lies of the HP, I ignored these in my MR as advised by Gordon, but should i mention them now in my appeal letter?

Revision rates at MR are very low, the DWP claim 30% bit we don't see anything like this on the forum, the rates for appeals is over 60% and we see better figures than this, also have a look at the following comment from a senior Tribunal Judge.

I just had the results of my MR today as well ( no change to the original decision) and it seems like he hasn't read any of my appeal and he totally agrees with the HP professional who was a young nurse in the job for 6 months. It says he totally trusts the HP's report and assessments in spite of the fact that I have pointed out that there was no full physical examination and that my doctor confirmed that the results of the muscular skeleton exam in the HPs report could not have been made without one. I went through every bit of the HP's report and quoted inaccuracies and inconsistencies but it didn't help.
I feel just like you and cannot face going through all this again but if we don't then they win. Good luck.. Linda

Thanks Gordon I didnt think I would get anywhere so I'm going to appeal to tribunal.

I've downloaded the form but should I enclose a copy of the descriptors I feel I meet ie copy and paste from my MR letter or write a new list of reasons?
Or just ask for the appeal as I feel the physiotherapist HP was not able to assess me for my mental health issues?
Can I bring up that she lied about tests she had carried out or should I still bite my tongue?

You need to provide reasons for your appeal but these do not have to be detailed at this time, you can do this if you make a submission for the appeal.

If you think that there are discrepancies in the assessment report then these may be reasons for your appeal, just understand that you will only receive an award by showing that you meet the criteria for one.

I know that you wouldn't do this anyway but for completeness, don't use words like "lie" in regard the assessor, just state things as they happened or did not and leave it to those looking at your claim to come to their own conclusions about the assessor.

Hi Linda I wasn't going to appeal as my health has suffered badly by the stress of all this and the fact I also have autistic child who is suicidal at the minute and I just can't cope with anymore. But after talking to my husband I agreed to go ahead and put in for the appeal as I can drop out before the tribunal if need be. As he says not appealing is exactly what they want you to do and why should we suffer due to their lies.

I got no points so I've nothing to lose only my sanity lol
