Hi Gordon.

I rang DWP yesterday requesting copy of medical and have just received.

The Assessor, a Doctor, states "the client found to meet the criteria for Limited Capability for Work and Work Related Activity".

Is it likely that this is what DWP will decide or could they come to a different decision and overturn the Assessor? I feel I should be jumping for joy and releaved, but I don't want to tempt fate!!

Unless there is something fundamentally wrong with the recommendation, which is unlikely, then I would expect the DWP to follow it and award you the Support Group.

ESA Decisions usually only take 2-4 weeks from the assessment.

Thanks Gordon. I have another question, sorry....

I receive standard rate PIP, £22 a week, and I only got this after a MR request. I have always felt I should be receiving enhanced mobility, but didn't want to upset the apple cart as it of course could be overturned. Anyway, the ESA report is accurate when is states I have severe disability and cannot walk more than a few metres without being in pain. Can I write to the DWP asking them for another MR or request them to reconsider their award, providing the ESA report as evidence? My PIP was awarded last autumn.

From your previous posts the PIP Decision was nearly six months ago, I would be very surprised of the DWP were to accept this information as part of a reconsideration of your current award, I would expect then to say that it is new.

You can however, report a Change of Circumstances, this needs to be done in writing and I would recommend that you send it using a tracked post so that you have proof of delivery.

Understand that doing this will result a full review of your award, the Daily Living Component as well, a new PIP2 and almost certainly a face to face assessment, so you need to be prepared for this.

Your current award will remain in payment until a new Decision is made.
