Mandatory Consideration

Well MR sent along with supporting evidence and a copy of a feedback/complaint letter that was sent to the Centre for Health and Disability assessments.
GP letter to follow as my surgery lost it at the dictation stage!

My worry now is that it is so close to the deadline. My decision was 7th March 2018. I could not get to see my advocate till Thursday the 5th and we spent 2 and 1/2 hours drafting the MR. He typed it up on MIND headed paper and emailed it to me today for me to print, add evidence and post. Obviously my worry is that tomorrow is the 7th of April, a month after my decision date.

I'm assuming this is acceptable? I sent it by recorded next day guaranteed delivery. Cost me £10.80! But I was so worried that I couldn't prove it got there by the deadline otherwise.

If the DWP make an issue over it. Is the fact that I needed support to do the MR and had to wait to access that support and acceptable reason?

Yes it would be but I would be surprised if the DWP reject your MR after the effort and expense you have made to get it to them within the month, they are supposed to exercise some discretion on matters like this.

So MR notice came back, decision unchanged. They have awarded me 6 points for 'getting about and dealing with people' but everything else if unchanged.

So appeal it is. I think I need to counter the decision maker more. There still banging on about stuff that was in the assessors medical report which i thought a copy of Mind's complaint would help counter but they don't seem to have used it. My MR was a bit rushed and was done by a MIND advocate which was fine but I still don't feel he is approaching it quite properly. I've download the appeal guide from here and will have a crack at it first before i see him.

I plan to go back to assessment rate ESA once my appeal is lodged, can I just enquire if SDP is paid with ESA assessment rate? (I also receive DLA and live by myself)
