ESA, PIP, starting work advice please.

Hi,

I’m hoping someone can help me please. I’m thinking of going back to work full time. Currently this is the situation:
Husband claims ESA (support group) and gets the partner element too, as well as various premiums for disability.
I get PIP due to bipolar disorder - DL enhanced
He gets PIP due to physical disability and mental health - enhanced mobility and standard DL.
We also get child tax credits and child benefit for our 3 kids under 16 (we have one over 16 who is working).

When I go to work I’m looking at roughly £27-£30k pa. I know this means his ESA claim will end. What happens to PIP? When should I end the claim (or should I?!) his PIP should stay as is as nothing changing for him.

Can he rapid reclaim ESA if everything goes down the pan when I work?

Is there a rapid reclaim for PIP for me?

Please let me know anything else relevant I may have missed.

PIP is not a means tested benefit so is not effected by any income that you might have from working.

It's not automatic that your PIP award will be effected by your starting work, but if you are doing so due to a change in your conditions then you must notify the DWP so that they can reassess you to see if you still meet the criteria.

There is no specific requirement for you to notify the DWP if your starting work, but it could count against you if you fail to do so and it is subsequently found that you no longer meet the criteria for your current award. Notifying then will almost certainly result in a reassessment of your claim.

His ESA claim would not be closed, your working 24 or more hours a week plus your income would prevent payment, so if you stopped working then all you should need to do is inform the DWP and it should be put back into payment.

As I explained, your PIP claim would not be closed, however if you are reassessed because you have started work and your award was removed, then it would be because the DWP believe you no longer qualified. You can make a new claim for PIP immediately but would have to overcome the criteria from scratch.
