I made an advance claim for Pension credit when receiving ESA(IR) but received no reply. I recently passed Pension Credit age and phoned the Pension Service they seemed to insist that I phone the ESA and stop my ESA claim before they process my PC claim. Surely the correct procedure would be to assess the PC claim and then make the correct supercession. If I do what was suggested then my HB and ESA would stop but without knowing what my PC is and more importantly when it would come into payment. My other option is to wait until I am 65 advance claim my state pension and PC at the same time, I am entitled to SDP and full state pension on present information. I am thinking of complaining to the pension service about this and want to know what arguments to make.

I suspect they have explained it badly.

If you are already receiving Income Related ESA then you will meet the criteria for Pension Credit, the assessment is purely financial and the requirements for PC are less strict than they are for ESA(IR).

ESA(IR) and PC are mutually exclusive benefits so you cannot make a claim for PC without closing your ESA(IR) claim first. The PC would start the day after your ESA stopped, bear in mind that ESA is paid fortnightly in arrears, so make the claim the day after you are normally paid.

Contact your Local Authority when you make the claim and there should be no problem with your Housing Benefit.
