Hello,

Does anyone know if the dates for cessation of payment for SMI benefits set out in Martin Lewis's article - see links beow - are correct?

If so then anyone who is about to be offered a loan instead has longer than until merely 5 April to consider their position, as the DEP keeps telling us.

I can't find anything online anywhere. CAB had no idea and the DWP are horribly vague!

The legislation replacing the current SMI payments and enabling SMI Loans come into effect on 6 April 2018

Thank you so much but unfortunately that doesn't answer my question. As I said, there are transitional provisions that seemingly allow for payment to continue until 15 July in the event application for the alternative loan payment is made and progressed with. The link I provided discusses this. I am seeking further information of this aspect.

There is no reference to a date of 15 July in the legislation or the Explanatory Notes. There may be on-going SMI payments during the six weeks that claimants are given to decide on whether to take up the load or not, but I would have to go through the legislation in detail to confirm this.

Sorry not to have been clear. You're correct; the 15 July date is from my own calculations of the timeframes afforded in the various scenarios provided for in the event a loan is applied for and/or persued.
Do you have a ink to the legislation at all? I'd love to go through it and can save you the bother of doing so :) All I can find is the 7 page memorandum which doesn't recite the relevant provisions.

Aha I found it! It's regulation 19 of this statutory instrument:

Martin Lewis was right and we do have longer than until the 5 April! It's disgraceful that DWP conceal this from us and that not one of their advisers appear to even know about it!
