Just wondered if this new ruling means the amount on my award letter has 37 pounds income related but I get the 109.65 contribution entitlement does this mean that they need to start paying the income related amount? Have been on this since 2015.

Forgive me but I am confused by your post which suggests that you are already receiving Income Related ESA in addition to your ESA(CB)

Sorry for confusion it states living expenses 0.00 it says support group ESA 37.65 . Your income related amount is 37.65 however because I am entitled to cont based they will pay me 110.75. Am confused about it all I was on income related for a number of years in 2015 I reconciled with my husband after a number of years so changed to cont based. It didn't work out but because he is my main carer and get CA they have left me on cont based. My housing benefit is paid in full as it is my lease only and always has been so not sure how it all works out.

OK, so you should be entitled to the Enhanced Disability Premium (£15.90/week) as you are in the SG, this should enable payment of ESA(IR) as a top-up to your ESA(CB), providing you have no other income or savings that prevent payment of this.

Your husband claiming CA against your DLA or PIP award prevents payment of the Severe Disability Premium (£62.45/week).

Did you inform the DWP that you were no longer with your husband again? You should be able to get the EDP back dated to when you separated again.

Hi Gordon yes I informed them of this in 2016, I have a personal pension of 99.82 per calendar month which they are aware of so not sure if this prevents EDP payment. My only other income is enhanced Care & Mobility. Because he got added to my claim for the year we were back together not sure if this had effect when it changed back. Although he's still my carer and has his own room etc, we've never had joint anything since original separation in 2009. As my care needs are severe he still looks after me along with my sister. I was under the impression that when I informed them in 2016 it would revert to IB.

Your pension exceeds what you would receive additionally as ESA(IR) so that's why it is not payable. When you were a couple the extra money you got for this exceeded your pension, now it doesn't.
