Thanks Gordon, I was under the impression because my only income(apart from PIP) from my private pension equates to 23.03 per week that I should be getting income based. My husbands income is nothing to do with me and I don't claim for him so am not sure what the amount is that the government says a person is supposed to be able to live on. My husband will be getting his state pension this year so will no longer having anyone getting carers for me so not sure if that will change things. Obviously he stays here as a carer only as I don't live alone I need constant care but am I right in thinking I won't get SDP and IB back.

Thanks once again Gordon

At the moment you are entitled to £15.90 of ESA(IR) however your pension of £23.03 is treated as income and deducted, so it's not payable. When your husband receives his pension and the CA is no longer payable then you should be entitled to the SDP as well, this will increase your ESA(IR) to £78.35 minus the £23.03 meaning £55.32 should be payable.

Thank you Gordon for clearing it all up for me, am not sure that I will get SDP as he lives in the house to care for me. Thanks anyway for all your help. Keep up the good work you do.

If he lives with you then no you will not get the SDP I'm afraid.
