Hi,

I would be grateful for some advice. I have been awarded standard daily living allowance but firmly believe I'm entitled to the enhanced rate. My decision letter was dated the 21/03/2018 but I didn't receive it until Friday the 30/03/2018. I want to request a copy of the face to face assessment report before deciding whether or not to submit a mandatory reconsideration request - in hindsight I should have requested this earlier but I was hopeful of getting a fair award from the outset. I was unable to call at the weekend to request the report as their offices are closed and with it being the Easter Holidays they were also closed on Monday and Tuesday (2nd & 3rd of April). I have again tried phoning this morning several times but unfortunately when getting through the automated answering machine tells me that I will be transferred to an advisor at which point the phone rings briefly before going to an engaged tone and then going completely dead. With it now being almost 2 weeks since the decision letter was dated I'm concerned that the 1 month period to submit a mandatory reconsideration will almost be gone by the time I receive a copy of the assessment report. In any case I have forwarded a request for the assessment report in writing yesterday and sent it via signed for post. As timescales are tight could I send in a very basic 2-3 line letter simply requesting a mandatory reconsideration and say that further evidence will be forwarded in due course. Should a basic letter now buy me additional time to submit further evidence stating my thoughts on why I feel the decision is wrong? I read somewhere that you would be allowed one further month to submit additional evidence but is this just for further medical evidence etc? Is it important to give reasons why I'm requesting a mandatory reconsideration from the outset or could this be done shortly after submitting a very basic reconsideration request letter?

I would make the MR request now with your basic reasons from the Decision Letter and say that you will be submitting more information once you have received a copy of the assessment report. the DWP should allow you four weeks to do this, although the time includes postage so be aware of this.
