Hello
Can you give me some advice please? ( I do Subscribe and have done for a number of years)
My husband has been awarded the High rate on the living section and the Low rate on the mobility section
for an “on going period” Does this mean “for life”?
He is at the moment appealing the decision as previously he was on high rate mobility as well
Can they take away his award or even part of it because of this appeal?
He is really, really upset about all this as his car to him is his lifeline but he is
so worried that they will stop his payments because he has appealed
Also if he is awarded could it be again “For Life” on going period

If possible can you reply ASAP as the court case is on Monday 9th April 2018

At this time we do not know what an On-Going award means in practice but I doubt very much that for the majority of claimants it will mean "for life", all we can say at this time is that it should not result in a reassessment, unless there is a Change of Circumstances for at least ten years.

If the panel at his appeal have doubts over the veracity of his current award then the Judge of the hearing is required to issue a warning and to adjourn the hearing so that the claimant can get advice on whether to withdraw the appeal or not.
