Hello i was asked to sit in on a FTF to be carried out at the home of my friends son ,he has had a damaged hip since he was 14 years old , they would not give him a new hip till he was older he has had the higher DLA and lower care . I sat with his partner and him i thought the assement went ok ,till he had his letter they have given him standard daily living .and standard rate of the mobilty . When we read the stateent i was concerned to see what the asser said that he had difficulty standing and he was observed pushing down on the chair arms to stand and use his crutches . He did not sit on the chair but on his bed as his chairs are to low the next concern they say he said at the assessment that he could walk using his crutches 20 to 25 metres and would need to stop-and rest .That is also not true . When he stood he has one leg shorter than the other and said he is in pain as soon as he tried to walk he did not walk far and than sat back down do we go for a mandatory reconideration

Yes Gordon he as had the higher for many years he is in pain all the time and when he puts his weight on his hip to walk he is in real pain , because his hip problem as gone on so long one leg is shorter than the other they say he has balance problems .his other hip is also causing problems because the transfer of his weight ,he now uses two arm sticks to walk , because he can stand then move using a aid or a appliance more tham 20 mts and no more than 50 he ticked-less than 20 mts on his PIP form and did not walk 6ft when being assed

If you reasonably think he should have score higher then consider an MR, how secure is his current award as an MR can reduce the points that he already has?

The first stage to challenging a Decision is for you to request a Mandatory Reconsideration, this needs to be done in writing to the DWP, within one month of the Decision, to the office that dealt with your claim, have a look at our PIP MR & Appeal guide for details of the process, the PIP area also has template letters that you can use to make the request with.

You should contact the DWP for a copy of the assessment report if you have not already done so, I would phone them but again follow up the request in writing. Once you have the assessment report you will have a better understanding of how the DWP Decision Maker has come to their conclusions and will then be able to argue against them.

Your primary task is to show that you meet the criteria, there are many reasons you may have failed, you need to address each of these but don't get bogged down in criticising the assessment report unless you can clearly show that it is incorrect, it is a lot easier to argue the facts of the situation;

"the assessor recorded that I walked 50m, I did but they have failed to document that I had to stop every 10m for a rest due to breathlessness"

than their opinions

"based on my observations of the claimant walking I believe that they can reliably walk more than 200m.

I have given my friends son the information regarding MR , and they could take points off him , as this happend to anyone one this site ,as i think he is afraid to go for a a Mandatory reconcideration he gets him self stressed
