TOPIC: Possible Back Pay from 2013 - IB to ESA (CB)

Possible Back Pay from 2013 - IB to ESA (CB) 5 months 1 week ago #210657

Following your recent news item, I received a letter from the DWP concerning the above on Monday, 16 April.

I was awarded IB in 2008 and was transferred (migrated) to ESA in 2013 following a WCA.

The letter states that I *may* be owed some back payment *if* they failed to award me any ESA (IR) due between 2013 and the present.

There's a tear-off slip to return in a pre-paid envelope if you DON'T want to pursue this.

You can either ring the dedicated Job Centre Plus Incapacity Benefit query line (freephone), or wait for them to call you on the number they held for you in 2013 within the next fortnight.

I chose to ring them, so I feel more in control, and then chose to go through their 20 part form over the telephone to avoid its getting lost in the post.

I was told I should receive a letter from the Decision Maker after 14 days, and was assured that they only require financial information: this will not trigger a F2F.

If I can provide any further information which may assist B&W and other forum users, please do ask.

Possible Back Pay from 2013 - IB to ESA (CB) 5 months 6 days ago #210718

Hi there Ivyfox,

Just the topic I’d been hoping to find on here. Thankyou in advance for your kind offer of assistance.

I too have received the same letter regarding possible under payments when converted from Incapacity Benefit to ESA.
I was placed in the Contribution Based Support Group, and this is still the case now.

The letter arrived on the 14th April and I received the phonecall today. They caught me at an inconvenient time, so I have asked for the relevant form to be sent out to me.

I get very anxious about any DWP form-filling, so I’m hoping you can allay some of my fears as to what to expect.
I have a number of questions regarding the form, if you don’t mind answering them please.........

1) How many pages long?
2) I gather they will ask about income and savings, but what other kind of questions are asked?
3) What types of income do they ask for?
4) Do you have to send proof of income?
5) Do you have to send proof of savings?
6) If so, what date do they require the info from?

7) The lady on the phone said that depending how much my company pension is per week, that this amount would be taken into account in the assessment and would lower the amount I could potentially receive. For example: Say my pension is £50pw, I would only receive £12.45pw instead of the full £62.45 severe disablement benefit.
Is this correct?

8) Also I’m quite confused regarding the criteria for receiving the Enhanced Premium and the Severe Disablement Premium.
I can’t seem to find any clear definitions as to how your illness/disability is assessed for each of them. Any ideas?

9) After sending the completed form back (or like you answering the questions in the phone), how long is it before you are notified if you qualify for the Income Based part of ESA ie: Enhanced or Severe Disablement Premiums?
10) How soon after the notification do you receive the potential arrears due?

11) I promise this is the last question, lol,
If you qualify for the Severe Premium, do you automatically receive the Enhanced Premium too?

I think I’m getting things very mixed up in my mind, it’s all whizzing round my head atm.
So I will be eternally grateful if you are able to answer some or all of my questions please.
Also if any Moderators are looking in on this thread and can help me too, that would be just great.

This is my first ever post on this forum. I’m sorry about the length of it and the number of questions. I do hope yous won’t hold it against me, lol, and you are happy to help my head from being a total shed (like it is atm, being packed out with all this stuff).

Kind Regards
BlondLes

Blondie

Q1-3 see that following

www.whatdotheyknow.com/request/136119/re...ch/3/ESA3%201012.pdf

Q4-5 they may and they may not there is no way to know in advance.

Q6 Possibly last six months

Q7 Yes, your pension will be deducted £ for £ from any Income Related ESA.

Q8 See

ESA Premiums

Q9 We don't have enough feedback on the forum to know, best guess is 2-4 weeks.

Q10 Probably another two week depending on the amount, larger amounts may take longer as they require more senior authorisation.

Q11 No they have different criteria. See the link I provided for Q8.

Thank you for responding to Blondie's questions, Gordon.

All I would amend is (using Blondie's numbering)

6. All questions apply for the entire period between date of migration (which she told me was April 2013) and the present day.

9. I was told that a decision would be made after 14 days and a letter issued.

Possible Back Pay from 2013 - IB to ESA (CB) 4 months 4 weeks ago #211107

Hello there
Forgive me for tagging into this thread, but I am somewhat confused about this possible back pay following transfer from IB to EAS (CB)
I believe that I was transferred back in 2011. I have been in support group ever since.
I have not received a letter like ivyfox or Blondie regarding this possible back pay.
How do I find out if I may be potential due entitled to any back pay ?
