Hi again Ivy,

Wonderful news regarding your I/R ESA assessment and subsequent backpay.
I do hope you're going to treat yourself to something nice with a bit of the money. A spot of retail therapy or a holiday does ya the world of good - great for the soul.
Thanks for the update too. It's great to know that the backpay will be disregarded from future total savings amounts, unless a new claim is made.
I sent my claim pack to them and I'm waiting for the assessment to be done and hopefully should hear from them within the next two weeks. Fingers x'd that I'll have some good news to share too..

I can now confirm that, after producing the correspondence from the DWP, my HB has recommenced.

Hi again Ivy and Gordon,
I finally received a very niiice IR backpay amount, and also a an increase to my fortnightly ESA benefit.
I am very pleased and it is definitely well worth completing the mammoth application form and sending the DWP evidence of savings and income.

However, I AM confused by the difference in wording in your letter Ivy, compared to mine. I quote from your letter.........
“We will not add the £xxxxx payment to any capital or savings you have already told us about until your claim ends. If you make a new claim for benefits after 19th April 2019 your benefit may be affected by this payment”

Whereas in my letter, it states the following different sentence.......
“ We will not add the £xxxxx payment to any capital or savings you have already told us about until 4th June 2019”

PAny chance either of you can shed any light onto why my letter reads so differently?

When you received the letter the DWP were taking the view that the failure to pay claimants was the result of an effective change in the law, the UTT Decision, this limited payments to 2014 and meant that the payments were only disregarded for 52 weeks.

They have now accepted that it was actually the result of Error on the part of the DWP, this means that payments will now be made from 2011 and that they will be permanently disregarded (on a continuous claim).

You may now receive an additional payment depending on when you were transferred to ESA and an updated letter.

Hi, Apologies for hijacking.
Just wanted confirmation pls
IB since 1997 ish to ESA Support all C/B continuing for example. No IR Topups etc.

Would there be any of this lovely 'back pay' coming mine or anyone else who are on C/B with No IR Topups
