I have recently noticed that there is an issue with regard to ESA benefit in 2011 in your news memoranda.

I was medically retired from work in 2011, and subsequently claimed ESA benefit. Because I had previously worked, I understood that I was entitled to Contribution based benefits. However, I was never assessed for income based benefits at the time of application.

The ESA people have most certainly never assessed my income and I am not really sure whether I am entitled to other benefits, and whether I may have missed out on other benefits as well.

Can you or anyone advise me whether I would come under the current case, or would I need to raise the matter myself to the DWP, as I am concerned that I may have missed out a considerable amount of money through no fault of my own. Apart from being unaware of the system.

If any one can help me, I would be most grateful.

The article is in regard Incapacity Benefit claimants who were transferred to ESA, so if yours was a new claim for ESA then it does not apply to you.

When you made your claim for ESA you had the option of asking for it to be Contribution Based only or to be assessed for Income Related ESA as well, so if you are only receiving ESA(CB) now then it is likely that you ticked the former.

You can still ask to be assessed for ESA(IR) but the DWP may argue that as you ticked the form for ESA(CB) only then you are not due any back payments.

ESA(IR) is dependant on your household income, your savings and assets, and any hours that your partner works. See

If you think that you would be eligible then or now then you need to contact the DWP office dealing with your claim and request an ESA3 form which captures information about your financial situation.
