Appeal advice please. was created by thisandthat
Hello, I have just received my PIP Mandatory Reconsideration award, and despite using all of the B&W guides and advice nothing has changed.I have still been awarded standard rate for
daily living (8pts) and mobility (10pts) . Despite the wrong and inaccurate information recorded the medical report, which I have corrected and argued the facts in my Mandatory Reconsideration appeal, I have had a different D/M that has possibly copied and pasted the original D/Ms award reasons and decisions. They did not even wait for further evidence, of which I am still waiting for from medical professions, such as my dentist, optician, who could give an independent account of my anxiety and disability. My M/R was returned less than 3weeks ago, and I specifically mentioned that I was waiting for more supporting information, and that it would be posted to DWP within 1 month of the M/R deadline. ( I’m sure that if the M/R is returned within the 1month item limit, than you have another month to gather more supporting information?) Any way if they had waited I think
it would of really helped me, regarding a lot of the facts that have been disputed.

So do I ring the DWP up to see if they would actually be interested in the supporting information that they should have waited for, as there was actually plenty of time for them to hold back their Decisions. Or do I use my new supporting info that I was going to send the DWP, but instead go straight to appeal .Any advice welcomed.
Kind regards.

You have nothing to lose by requesting a second MR, appeal wait times are around nine months across most of the country.

Thank you Gordon, am I able to ask for a second M/R, and if I can, will the supporting info be enough? Or will I have to start from scratch as if it were the first M/R and give my reasons again? Because that side of my disagreement has been fully explained in writing regarding the descriptors I have / or not been awarded. It was pretty comprehensive and I do not think I could do it any better, and I do not see what could be gained.. it would be really good if they could just inspect the supporting info along side my first M/R ( of which is still within a month of sending supporting info and evidence of the first M/R. The only trouble is that I am still waiting for it, and as I am not being charged for it, I can’t keep nagging them although I have politely given them my deadline.
Kind regards, Jonathan

Whether you can get a second MR will be dependant on the DWP agreeing to it, however, they are very unlikely to do one if you have no new evidence, which at this time you say that you do not!

So, you can wait for these reports but the longer that you wait the more likely that the DWP will not agree to another MR, or you can go on to appeal.
