To be clear I don't know, but UC has it's own legislation for "ESA" and I am wondering if this is the same for HB and the other benefits that it covers.

To update,

Housing Benefit Regulations won't apply in such a scenario.

UC does have its own regulations for this.

They are found under Universal Credit Regulations 2013, Schedule 4 - Part 3,Paragraph 16.

The section is worded with the references to 'any renter' or 'joint renter' instead of 'claimant' or 'claimants partner' as found under HB Regulations.

Misleading perhaps ? The protections are the same.

UC may claim the word 'renter' does not apply to 'claimants' : point out the Universal Credit Regulations 2013, Paragraph 1(2) of Schedule 4, part 1-- which clearly states it does.

Just realised a typo in my message:

should read:

They are found under Universal Credit Regulations 2013, Schedule 4 - Part 3,Paragraph 15'

Paragraph 15 is where the actual regulations are found.
