ESA rules for working partner was created by colinkw39
Hi
I currently get IR ESA in support group as well as enhanced PIP daily living..no mobility. My partner plans to move in permantley with me later this year..She works 30 hours but could reduce to UNDER 24 hours per week She is on minimum wage..How would this affect my ESA claim ?
your advice please..much appreciated.

I would put your information into one of the online benefit calculators.

www.gov.uk/benefits-calculators

Some quick points based on your post, if your partner works for 24 or more hours a week then your ESA(IR) will be stopped, even if they reduced their hours then there income will be deducted from your ESA and may erode it completely.

If you are receiving the Severe Disability Premium then this will stop unless less your partner also receives a qualifying benefit.

Thanks for the super advice...Partner has decied to give her notice at work and movie in..can we claim as a couple ?
Point 2.....forgot to mention we were married in November, Scotland 2016 I live in England and she worked & lived in Scotland but as I suffer with mental illness I was not aware until today while looking at their website that I needed to report change of circumstances...Will DWP fine me..persecute or prosecute me for not reporting change of circumstances ? this whole situation has me very upset as is detrimental to my Mental health....your advice please....

You should have told the DWP immediate about your marriage and you must now do so as soon as you can.

I don't think it will be an issue as your post suggests that you have not been living as a couple, however, the DWP may question why you have not.

Yes my parther was living & working in Scotland....She has of course visited me on weekends & vice versa... she has scottish address/payslips etc..she recently moved to England but has been staying at my Daughter's home for a few months who is in full time work..circumstances have now allowed her to move in with me soon would this suffice the DWP question ?

Forgot to ask Gordon should I write to DWP re marriage or telephone them ?...I prefer not to phone them as this causes me much stress
