HI Gordon!
Well things have not turned out as i was expecting!
Since my last post i have had a JCP lady fill in ESA3 for me regarding separation from my wife and change of address could not do it myself as blind;she made numerous errors leaving info of joint claim on form.
Spoke to DWP adviser said he had corrected errors and i would be getting an ESAIR top up to my CB ESA.
Waited for response,nothing arrived.
Phoned again;this lady said that person on phone had made more errors would check my files phone me back next day.
In that phone call she said she looked at my file thoroughly and i would be entitled to ESA IR top up back dated to 25 MAY 18 and a possible windfall backdating to my transfer to ESA in 2011.
Got a decision letter saying i was in WRAG phoned again. to be told that was a mistake and that yes i was in support group;however my transitional payment had been reduced by £23 a week.
I asked why SUPRISE he said he did not know!!!!
He also said that i had been given miss information about IR ESA top up;as i could only have one or the other either CB or IR but not both.
I know that's not true as online calculators now say as a single person receiving my supposed new benefits and living alone without care should get a £52/week top up.
Regarding the ESA reduction i know that there are no dependant additions in ESA ;but i had addition for my kids in IB.
I sent them a letter saying my daughter had stopped getting ch/benefit;the response was no change to ESA no action required. As i said in previous post i got no money whatsoever on my IB claim for my wife.
I cant understand what they have done and they don't know why either.
Getting nowhere went to my local JCP yesterday same response from the adviser could not help me as my case was very complex ; what! wife left and i changed address that's complex.
No hope there cr*p the info is right there but they cant work it out right.
I get PIP,ESA/CB,HB AND CT SUPPORT
Any advise as how to resole this and there incompetence would be very welcome.

I'm sorry but I am limited on the advice I can give as I don't have an in depth understanding of your situation, you can try putting your information into one of the online benefit calculators

www.gov.uk/benefits-calculators

or get face to face advice from a trained advisor, do an internet search for "welfare advice" with your postcode, town or county.

So any Transitional Payment you receive was set at the time of transfer, the original amount it is not recalculated subsequently, only reduced as your ESA increases, so your no longer receiving CB for your daughter is not a relevant factor.

Any Transitional Payment will be deducted £ for £ from any ESA(IR) entitlement and may prevent payment.

Your immediate entitlement to ESA(IR) is separate from your historical one, so if you weren't entitled to ESA(IR) when transferred to ESA, it does not mean that you aren't now and if you aren't now, it may not mean that you weren't when transferred.

As you are aware; ESA(IR) does not replace ESA(CB), you still retain an underlying entitlement to ESA(CB).

Beyond that, all I can suggest is that you contact the DWP, rather than trying to deal with all of the issues at once, try and persuade them to deal with them one at a time, if this still fails then ask for a call back from a manager.

Dear Gordon!
I don't expect any reply from you to this;i just want to say that your hard work is very much appreciated by me and others!
The advice given by you regarding CB ESA and IR ESA top up, transitional payments being set at time of transfer, mirror exactly what i have related to ALL the DWP staff i have had to deal with they don't appear to know their own legislation.
The last one commented that;we all have our own little area of expertise,that's not much use
when clients need answers!!
However your response has given me the confidence; that i am on the right lines in my thinking and response to them.
I would also like to add that with your advice in an earlier DWP error meant ;when meeting CAB i had a better over view than the adviser at the time.
