Non attendance of ESA ftf Health Assessment

I have ME/CFS for 25 years plus, received the usual ESA50 beginning April, filled in diligently and posted back to Maximus, received a letter shortly afterwards for an assessment with a HP which would have been for today, but rang them to tell them I would not be attending and told them I could not put myself through the stress physically and emotionally, I must point out that a major factor in my decision making was that in 8 weeks I am due to receive my State Pension!! My last assessment 3 years ago the ESA85a states *work unlikely in the longer term* No doubt I will receive a letter stating thet my benefit has been stopped, that is my choice. with 8 weeks to go where is the logic in their assessments??? I will keep you posted.

Today received a phone call from DWP asking me why I failed to attend the Maximus assessment, told them it should be on file as I had rang to tell them reason, they said did not have it but when I gave them the date, time and person I spoke to they then said had found it.
i re-affirmed the reasons and they then said that if it was within 3 months of receiving state pension age it would be exempt!!! I presume I was just outside of this. But i still insisted that what would there be to gain so close to retirement. They are going to pass it on to a Decision Matter. The saga continues.

This morning received expected brown envelope from Job Centre Plus stating as I had expected because of Non Attendance my benefit would stop last payment will be 11th May,and as of 1st May I am capable of work!!! I am now deciding with even less weeks nearing to State Pension whether to just roll up in a ball or pursue it further. Needless to say it is still a hostile environment, and I possibly have helped them to meet their targets, At this end of the game people like us are easy pickings.

You could contact your MP on the basis that it is a waste of Public Funds to assess someone so close to their retirement date.

Gordon thanks, I may well do that, I have decided to ask them to reconsider with a Mandatory Reconsideration, it is probably a long shot but I have nothing to lose!! (I downloaded Form CRMR1 01/18 (Mandatory Reconsideration Form) from GOV.UK /- I didnt know it existed.I thought it would make it easier, on Page 2 it gives boxes with days and times for you to tick for best times to contact you if they need to. (which I felt was useful)
