Hi,

We went to the tribunal last year and were awarded both components of PIP. However we were only awarded this for 1 year. My daughter who is 18 has autism. We had to re-apply this year and DWP awarded 0 points. We now appealing to the tribunal for the second time. Is this common? Since my daughter has been to the tribunal last year, I have decided not to take her due to her anxiety since I am her appointee. Since this is also causing me anxiety and stress and based on the fact that we went last year, could someone please advise me on whether I should ask for a paper hearing or should I still go to the appeal myself?.

Thank you very much for any advice you can give.

You and her cannot be required to attend if you have asked for a Paper hearing but be aware, statistically the success rate for hearings that no one attends is a fair bit lower than for those that are attended.

You don't need to make an immediate decision on this, ask for an Oral hearing and you can switch to a Paper hearing at anytime, including the day of the hearing.

If you don't want your daughter to have to attend, then contact the Judge assigned to the hearing via the Clerk of the Court for the venue and ask permission to attend in her place.

Thank you Gordon. Is it a common occurrence to have to go to the tribunal just one year after the tribunal awarded PIP last year? In your opinion, why do you think that the tribunal awarded PIP for just one year, given that my daughter has a life-long condition?

I can't really comment on the previous Tribunal Decision to only award for one year, did you appeal for a higher award? If you did then they may have used the award length that the DWP offered.
