Hi,
I'm requesting a mandatory reconsideration of decision to close claim for esa.
Should medical evidence I send in cover period from benefit stopped until present time, or should evidence be about the actual date of decision letter?
Is my good cause related to period from benefit stopped till now, or focused on date of decision .
(was in support group, long term health probs.)
Also, do I need fit note to cover period from benefit stopped or would medical evidence letter cover that? (should I ask gp for fit note to send with MR request and medical evidence?)
I'm wondering am I covered by previous fit notes at this point, or am I in limbo re health status and esa claim? do they take into account previous fit notes and support group info?
Can you tell me if there are time limits on re-assessment process for esa and can they be appealed against?
Would really appreciate any advice on these points, feel I'm getting confused trying to clarify getting correct info gathered together for MR request, plus worried running low on time.

So this is in regard to your not returning the ESA50 by the required date?
Any Good Cause and any medical evidence you supply must be in relation to your reasons for not returning the form. they are not going to be looking at your entitlement to ESA. Information since the date of the Decision may be supportive of your health problems prior to it, but you ideally need information covering the period from when your received the form to the date it had to be returned by.
There are no time limits for an MR to be completed in, average times are 5-8 weeks, if the Decision is not revised in your favour then you can appeal but be aware, you will not be entitled to payment of the ESA Assessment rate while you wait for a hearing which could easily be six months.
