Pip tribunal win now arrears owed was created by A4H2009
On 20th of this month I won my tribunal and my waiting time for my tribunal was a whopping 21 months. The DWP owe me £8,600. Now I'm worried they will not give me this as such a large amount because my wife won her tribunal and within 10 days she was paid £3,100. Its now been 15 days and I've still had no letter saying when my arrears will be in the bank and when my pip starts. I'm scared the DWP will appeal as it's a large amount of money. What also is concerning me is that if they do pay me they will deduct my benefits as you are only allowed to have £6,000 in savings before they deduct benefit. And as my arrears are £8,600 I'm screwed with that one. The moment they pay me (if they do) nearly £4,000 will be paid to a loan shark as I had to borrow money to keep me and my wife going for nearly 2 years so they should class my savings as £4,600 so I should be ok I think. My wife's £3,100 arrears went straight to the 3 bank account overdrafts which are £1,000 each. Please please somebody give me some advice on this matter as I'm so worried and stressed about this, my stress levels were through the roof waiting 21 months for my tribunal win just to worry about whether they will pay me and if they will deduct my benefits if they do pay.

It usually takes the DWP 5-8 weeks to process a Tribunal result.

The DWP don't get to "choose" how much back payment they owe a claimant, if they owe you more than £8000 then that's how much they will have to pay. A large payment can require a manager's signature and this can delay the process of your receiving it.

Back payments should be disregarded for 52 weeks.

So you asked about what would happen if your back payments took you over the £6000 limit, the back payments will be ignored (disregarded) for 52 weeks before they are considered as part of your savings (capital).

Surely PIP is not means tested?.... Only if it was ESA, there would be a limit before deductions? I certainly hope so.
