Following on from us having to tell the assessor that turned up that we didnt wish for her to do the assessment, we have now recieved a letter stating that my husband is no longer entitled to pip as he didnt participate and didnt give a sufficient reason for not despite me sending a full letter explaining the reasons.
My husband and i are both devastated but intend to fight it. What is the next best step? Obviously go for the MR but should i get someone else to back it up?
I know this decision is going to impact us finacially and also health wise as already my husband is ill with worry from it

I'm not sure what you mean by "should i get someone else to back it up"?
The first stage to challenging a Decision is for you to request a Mandatory Reconsideration, this needs to be done in writing to the DWP, within one month of the Decision, to the office that dealt with his claim, have a look at our PIP MR & Appeal guide for details of the process, the PIP area also has template letters that you can use to make the request with.

Hi gordon,
No they didnt ask for our reasons not to participate however i had ensured to contact them by phone within minutes of the assessor turning up and then followed this up with a letter explaining that we were not happy to have the same assessor as i had previously had last year. We just got the letter this morning stating that they had looked at the application and decided he wasnt eligible due to not participating.
What i meant with someone else to back the appeal up - should i get someone such as a disability organisation or local mp etc to write in as well to support the MR?

Given the nature of the Decision all you need to do is explain why you refused to accept the assessor who attended.
