DLA promised decision on hold till further medical

HI hope you can help, the dwp promised me over the telephone that they would put my decision on hold until further medical evidence received. The operator said I cant make the decision but if you hang on Ill go through to the case manager. On return she said yes we will, Ill put a note on your file, that was Monday 14th May. On Sat 19th I got a decision letter nill points and owe money to pay back. I was devastated, distroit, how could this happen.

I telephoned them and they said someone will phone you back in up to 2 weeks. They will listen to the call and put a complaint in about the operator. Thats no good to me becasue If I need to go to MR i may be out of time. I just dont know what to do. They left me hanging. What do you think they will do, thanks

If the DWP have made a Decision then you only option for challenging it is by requesting an MR, you have one month to do this, however, if you can show Good Cause for doing so, you can make Late request.

But if it is proved that they lied to me by listening to the recordeing call, will they honour the time and extend the decision. That way I may not have to pay back money and get to submit my medical evidence before MR thanks

They are under no obligation to do so, your post suggests that the DWP are saying that the call operator did not have authority to tell you what they did.

I'm afraid you will have to wait and see what happens.

The call handler went through to the case manager becasue she said that she did not have authority to make that decision. She put me on hold. She came back to me and said yes she has agreed to put it on hold until further medical evidence has come in, ill note your file. Which she did. But the decision had already been made. So it was the case manager that agreed.

You said that they were going to call you back, you will have to wait for this.

Where are you with the GP letter?
