I sent a Mandatory Reconsideration letter on 16th Feb and 2 follow up letters chasing it. I finally received a reply stating "as new rules for psychological distress were not coming in until June they were delaying decision until then". If I did not want to wait until then I could send a reply stating I wanted it looked at now. I did not do this as there was little point.

I received a letter today saying my MD had failed and I would not get PIP. It then stated it could be reviewed in June. I do not understand why they have gone ahead and made the decision when I did not ask them to. I don't know whether to write back and ask why they had done this when I had not asked them to or sit tight and hope they do review it again in June.

It does seem rather idiotic to me that they know what the criteria is for the Overwhelming Distress but are still following old guidelines. Surely this will cause them more work!!

Did you reply to the DWP's letter, if you didn't then this is likely why they made a Decision and did not wait until June.

The Government's handling of this situation has been truly appalling setting a new low for the DWP. Unfortunately there is nothing that claimants can do about the situation, you can appeal but with appeals taking the best part of nine months to be heard it won't be any quicker.

The only advice I can give is for you to make sure that you understand the criteria for the Going Out activity, based on the posts I see in the forum members do not always understand the requirements.

Thanks Gordon,

I have read all the information on here and followed it, even the HCP told me to make sure I appeal if turned down!! The right arm does not seem to know what the left is doing!! I am definitely going to appeal as I have bowel incontinence so it is impossible for me to travel to unfamiliar places on my own as I am terrified I will have an "accident". This has happened to me and I have panic attacks. I know the PIP will only be £22 or so a week but it is more about the principle of the thing and I want to get the message across of how crippling incontinence can be. My son had his bowel removed (ulcerative colitis) and we had to go to the tribunal to get him PIP so I am aware of the process and prepared to fight. Just feel sorry for those who are in far worse position then me.

Incontinence problems will not directly allow you to score for the Going Out activity, you will need to show that it leads to overwhelming psychological distress and it is this distress that stops you from following a route.
