My time has come for ESA again after four years. was created by ThisGovernmentsGoneToFar
Well Gordon and all after going through PIP and sending all the evidence in and they agreed I'm ill and knackered and granted an ongoing for PIP and know reviews necessary on my PA3 this was less than 6 months ago and now they are now inflicting this ESA process on me again which atmo I'm in the Support group and they even stated deterioration in function noted on my ESA85a?

To be honest I've had enough I really can't cope with it anymore why on Earth they can't use PIP paperwork to see what I've sent before and looking at the ESA descriptors my PIP fits most of them, I also have had manual wheelchair test and i have documented evidence I can't use one it's so degrading, they have so much medical evidence of support and still they are going at me. Well this is my last quest with these fking fools I really cannot carry on like this.

I have involved my support team to help sort this out and there going to deal with it as I've point blank will never go to a FTF again, but as I've said why this hassle all the time do the DWP get a kick out of hurting us.

Gordon is their any pointers you can offer, i have noticed some differences in the new ESA50 comared to my last one in 2014.

I will also ne adding anout the wheelchair one as my Dr has pointed it out, as you know Gordon from the evidence i posted a whil ago regardimg my PIP stating all revelevent imformation regarding self harming etc, i just feel at such a loss.

I know when an assesment comes my support team is going to tell them i cant cope with anymore like they did with my PIP i hope this will help as i cant anymore im scared i cant work and they now it.

Also Gordon should i send all the PIP decision or just the evidence and there opion not to have review and ther justification why now review. Confused by all this now.

Any further advice would be grateful. Thanks

The main area of change is in the guidance for the Substantial Risk Regulations, it is now much more difficult to get into the SG through this route.

I would send the PIP Decision and the evidence, but you must related this to the ESA criteria or you risk it being ignored as not relevant., there are areas of overlap but even where they are the criteria is different.

Hopefully this time they will decide that there is no need for further assessment.

Gordon i understand that i was placed in the support group for mobility issues at that time, since 5 years ive been under mental heath for self harm, trying to hang myself cutting my body to pieces overdosing etc, its all well documented.

I have evidence i cant propel wheelchair or walk very far at all.

I get that with the PIP critera. They know im getting worse and its all lifelong and COPD stage 3 is not foing away either. Im hoping this will ne the last but i havent heard of many being exempt.

Hiya Gordon i wonder if you can advise on this a little further Im going to add most of my information from my previous ESA form and add all the latest stuff to it.

I have spoke to my local council about Nil income if it all goes wrong and I’m told I have to go on JSA or UC I won’t be signing on to it and I will appeal, as I know now the DWP send forms not to issue fit notes if found fit for work, so I will have to try and live of my emhance PIP til then. They the council said I can claim under Nil income to save me loosing my home.

I don’t know if I’m thrown of ESA and don’t claim JSA or UC until appeal if it will effect me loosing my PIP.

Im so depressed I don’t know which way to turn its all a blur.

As for fighting I will try but I find anything and life a constant battle, my support lady is a head CPN and my psychiatrist will do their upmost to help as they know what I’ve done to myself over the years they are very supportive of the way have and we are all treated. I have fantastic reports from them what this is all doing to me in fine detail outlining everything I don’t cope with all updated plus im addimg sll what i did before as its all relevent still.

Gordon should i send the CM decision letter and the full PA3 PIP aswell as the CM which she also states (I agree you have great difficulty) and thats stated on that decision letter regarding my PIP.

I really appreciate all you help as its given me tpa little streamth to carry on.
All my issues have been stated they are lifelong and will only deteriorate with age.

Someone mentioned going to you MP?

My MP is a conservative Lucy Allen she won’t care about us, and I woulden’t know where to start with that process with MPs as I don’t trust strangers at all FTF because of many reasons when I was young it takes me a long time to open up to anyone FTF?
Thats why I won’t go to an assesment FTF.

I don't think we have seen anybody's PIP award effected by a negative ESA Decision.

ESA is not payable during an MR but if you go onto to appeal then you can receive the Assessment rate, providing you have not claim UC i the interim. I know that the DWP often write to GPs but the issuing of a Fit Note is a medical Decision and up to the doctor.

Yes, send the Decision and the report.

At the moment I don't think you have reason to go to your MP but don't assume, just because they are a Conservative that they won't help, that's not the feedback that we get from other members.

Have you spoken to your MH team about what they can do for you to avoid a FTF?
