ESA is not payable during an MR but if you go onto to appeal then you can receive the Assessment rate, providing you have not claim UC i the interim. I know that the DWP often write to GPs but the issuing of a Fit Note is a medical Decision and up to the doctor.

Yes, send the Decision and the report.

At the moment I don't think you have reason to go to your MP but don't assume, just because they are a Conservative that they won't help, that's not the feedback that we get from other members.

Have you spoken to your MH team about what they can do for you to avoid a FTF?

Thanks Gordon as I'm at the end of my tether now regardimg benifits, I did know ESA MR at assesment rate and it is not payable without a Fit note, I will appeal after I get a MR notice and live of my PIP until then and not UC or anything I can't commit too, hence why I will not going to signimg on for JSA Or UC (I can't work end of) in fked and they darn well no it.

I'm not signing on for something I can't commit to doing! I will live on my PIP.

I just dont want to loose because of it all and what I have as it's ongoing PIP, E both.

As for MH team they will talk with Maximus once and if I get a FTF and do what they done with Capita, and I then ended up with a PB assessment for PIP, yes the letters can't cope at assesment etc unambiguous as you put it.

If my PIP will be not lost if I have to go down the road of No income so be it I really can't cope anymore. If I could work I would get a darn job to save all this grief and hassle.

Re: Fite notes I did say to you a while ago I had to move Gp practice and don't know them very well as my old surgury was forced to close, so even getting a Fite note may prove hard even if the DWP right and tell them not to give one I don't know? I get 3 predated prescriptions again my MH sorted them out I'm just know good with FTF because of trust issues etc.

MPs it's something that is mentioned on here and thought if I needed to go down that road.

Summing everything up Gordon if the worst comes to the worst and if I can keep my PIP I will try and manage on that I can't deal with much more of this Governments crap policy's.

Anymore advice is always welcomed. TG sorry for rambling I would love to be able to work and be Indipendent again instead of this inhuman system.

My spelling is all over the place.. Gordon.

This should have stated: I have spoke to my local council about Nil income if it all goes wrong.. I’m told I DON'T have to SIGN or GO on JSA or UC I won’t be signing on to it and I will appeal, as I said I will have to try and live of my PIP til then. They, the council then said I can claim under Nil income to save me loosing my home.

It seems to me that you are getting ahead of yourself, worrying about MRs and appeals when your first post suggests that you have only just received the ESA50.

Try and deal with the issues in front of you and not worry about the ones that might not even happen. :)

Gordon you may well be right buddy, infact you are I've taken so much medication and I'm all over the place also having a mental breakdown don't help.

I will just have to see what happens that's the bottom line really. What will be.

Gordon just a little update, yes I've calm done a bit.

Ive spoke in depth with my team today and she and my psychiatrist have done statements of what this is and is doing to my health, she is now taking over all the dealings with the DWP and Maximus, I have to add her on the form as my appointee and my contact, my psychiatrist has added on his report too, to contact him for any further info if needed.

The updated support letters are detailing all my functional and not coping issues and what I done by trying to take my life and how I don't cope with people FTF plus Much more, she also said put my PIP form PA3 In with the formi as well as it clearly states many of the ESA questions.

Plus I will add all the history paperwork I also have again and on top of what I've sent before.

I feel this will take a lot of pressure from me as I just can't cope with it.

Just to add Gordon This is all on my PIP PA3 and it clearly states what is below.

Based on the claimants circumstances, it is not appropriate to review the claim.

Justification for review choice: Further evidence he is significantly debilitated by his MH and PH and that his condition is unlikely to improve, if anything , it's most likely to deteriorate. A review period seems unnecessary.


Then on the part where it states additional information, goes on and explains all the diagnosis and details from my completed PIP2 form and all my further evidence that I added and everything that's wrong with me and what I've done to myself and all the info about cannot use wheelchair, COPD, high risk self harming, poor mobility. This list is endless. I'm on ten yes ten types of medications a day, 3 types on morphine 52mcg transdermal patches etc.

So Gordon I was just going to add everything in with the ESA50 and then they can contact my team for anything they like.

What do you think have I enough to send in and using my PIP outcome as it's all up to date.

Make sure that you or your team do all of the things necessary for your ESA claim, so having been sent an ESA50 it must be returned by the required date, there are no extensions for doing this so don't lose track of the process.
