Hi, I need quite urgent assistance with postponed appeal for pip i was on dla higher rate mobility so am wondering how to correct a terrible answer i gave at my appeal, i was askex how far i could walk and i replied ten minutes in z country park, dont even no why i said something like tgat as i cant do that and the judge postponed my appeal for 6 weeks for me to decide if i should withdraw my appeal. I was very stressed in meeting and i may have mis understood her, but i wasnt given a chance to say anything else. The judge aas a bit hasty and a bit impatient, anyway she was a lawyer. I need to know how to proceed asap. I am 67 year old and walk with the aid of a walking stick, I have a Neuro stimulator implanted , and I take strong medication, I was very nervous at my appeal, I am in pain constantly, i work tuesdays wednesdays and thursdays. I don't want to finish work. I trialed metro link and dreadful as like sardines other passengers bump and squash me ,also couldn't do bus journey,same problem, train as with metro link lifts either broke,homeless In them and way to many stairs ,at Bury escalator broke for last few months at least, and train near home hall with wood station Bolton there are 33 steps to get to platform x impossible , when on strike info not on gate as you enter to get train so lots of time energy use to no avail, then I have a vehicle as I had to get car ,but it takes so long in traffic trying to get out of Manchester city centre where I work, I really can't sit that long ,it's so very uncomfortable and painful, it takes up to 1 and quarter hours to get out of tiny crossroads in city centre before you get 200 meters to were you can actually travel reasonably . This has been getting worse for nearly 2 to three years now. So I need help and advice please.

From your post it sounds as if the Judge has issued you a warning that your existing award may be effected if you continue with the appeal, this does not mean that it will but you should take the warning seriously and consider whether to withdraw the appeal. Having issued a warning it is standard to adjourn the hearing to allow the claimant to decide what they are going to do.

If you decide to continue with the appeal, then you will need to address the statement you made at the first hearing, walking even at a slow pace for would suggest to the panel that you can walk 500m or more.

You also need to think about the evidence and testimony that you have already made for the appeal, I think it unlikely that the warning was issued solely on your comment which would suggest that your case has not been presented well.
