PIP appeal won and enhanced awarded on both

Hi all finally had my appeal heard on 17th may and I won my appeal and was awarded enhanced on both daily living and mobility I am now told that dwp can challenge this decision what is the chances of this happening please if anybody knows or has had this happen to them it does state that the tribunal placed particular reliance upon the evidence of the bundle the evidence supplied was all medical evidence and statements from drs I am due to go for ACDF surgery on 8th June so am already very anxious and distressed now worrying about that and to now be told that the appeal decision can be challenged is very worrying for me as I have struggled to live since dla being stopped on 10th December after being failed at atos medical due to not being listened to and also not having my how my disability affects me form the atos lady did not take into consideration any of my mental health needs anyway she awarded me 7 on tail g living and 6 on mobility I have now been awarded 13 on daily living and 14 on mobility I am just worried it may be challenged even tho I have nothing to hide I am just worried.my mental health just really can not take any more I am barely coping as it is many thanks

First of all, congratulations on the award, well done.

Both the claimant and the DWP have a further right of appeal when a First Tier Tribunal Decision is made, however they cannot take the matter further because they disagree with the Decision, only because they can show that there was an Error of Law in the Making of the Decision.

It would be unusual for there to be an Error but they do happen. The DWP have one month from the date of the hearing to start the process, you will be informed if they do.

AS a result of the above it usually takes the DWP about 5-8 weeks to process a Tribunal result, I would give them a call to make sure that they have received the Decision Notice.
