Having recently moved I got the original date for my PIP review form return of 4th May extended to 18th May. I was told if I needed longer I should ring before the 18th May and they will get a claim manager to extended it further.

The move made me quite ill so I phoned on 15th May and it was extended til 8th June.

My paperwork is together and I am going to post Next Day Delivery, but this afternoon I got a letter from PIP saying my claim was closed because the form hadn't been returned by the 4th May.

I spent nearly 2hrs on the phone this evening to find out what has happened. The initial guy on the phone was at a loss as he said it clearly said return by 8th June.

He put me through to a case manager who was dumbfounded as to what they had done.

As it stands, I will get 2 weeks money on Thursday of this week and then nothing til not only the form is returned but also til they have reviewed it in around 6 weeks. My claim has been closed and I have done nothing wrong.

I am posting everything tomorrow but can they do this when I have done nothing wrong?

Request a Mandatory Reconsideration of the Decision to close your claim, the fact that the later return date is clearly documented on their system means you have Good Cause for returning it on the date you did.

Ok thank you. Can I put the MR written request in with the form? If so I will send Tuesday. I made a special effort to make sure I got these extensions as I didn't want a repeat of the ESA Tribunal shenanigans I had just over a year ago, and STILL I end up losing my benefit for no valid reason.

No send the MR request separately, I would expect the addresses to be different.

Unlike ESA where the legislation does not allow any extension to the time to return the form, PIP does so this is not an issue of your exceeding what the DWP allowed.

I spoke to another case manager today who says she has started an MR, but my claim will be reopened the minute the form is received. I am going to post the form in a minute. I have requested an MR on it but I will have to post a separate MR request tomorrow. Not enough time to type now.

I think I will contact my MP over this. Thank you for your help. I will come back to you with any news as I get it.

I just wanted to let you know I received my shortfall on Tuesday which means my PIP must have been reinstated. I have had no letter confirming this and so will be ringing them today. I now have to wait to see if I need to have a f2f or whether I will get a paper based review.
