Having received an award notice for just standard rate care I telephoned DWP to query award and they VOLUNTEERED to send the report which arrived just two days later. The errors and mistakes are alarming: Co-codamol 8 tablets 4 times a day!!! Cannot get into the bath then very next paragraph gets into the bath to clean herself all this despite acknowledging elsewhere that we have a wet-room with shower and no bath!! States cannot grip with thumb and fingers then states uses a grabber!
There are several more glaring mistakes and I am so wanting to challenge this report with a mandatory reconsideration but I'm scared to do so. My points total is 12 for daily living and carer says should be 18.
Any advice please ???

Just to confirm you have an Enhanced award of Daily Living and you did not expect to score for the Mobility component?

If this is the case then I see no value in you asking for an MR, you are already receiving the highest award then scoring extra points, which might well not happen at an MR cannot increase your payments and you run the risk, as you scored the minimum required, of actually losing points at the MR and you current award.

Hi, awarded standard daily living and no mobility. I expected a mobility award as cannot walk more than 20 meters without severe pain, unable to go out on my own. Cannot cook a meal and need to be helped while washing and dressing. Was declared unfit for work by DWP (?) over twenty years ago. Pensioner in 68th year.

Sorry I'm confused your previous post says that you scored 12 points for Daily Living?

Did you score anything for Mobility?

Hi Gordon, my mistake; 11 points for daily living and 4 for mobility. The assessor herself states that walking was difficult and needed support over what she said was 3o meters but have since been back to the building and the distance is only 17.
Reading the report makes it abundantly clear that the assessor kept getting me mixed up with some one else and that the case manager did not read the report fully otherwise he would have noticed the shocking mistakes.
These people should be made to take more care as it is peoples lives they are influencing.

The first stage to challenging a Decision is for you to request a Mandatory Reconsideration, this needs to be done in writing to the DWP, within one month of the Decision, to the office that dealt with your claim, have a look at our PIP MR & Appeal guide for details of the process, the PIP area also has template letters that you can use to make the request with.

You should contact the DWP for a copy of the assessment report if you have not already done so, I would phone them but again follow up the request in writing. Once you have the assessment report you will have a better understanding of how the DWP Decision Maker has come to their conclusions and will then be able to argue against them.

Your primary task is to show that you meet the criteria, there are many reasons you may have failed, you need to address each of these but don't get bogged down in criticising the assessment report unless you can clearly show that it is incorrect, it is a lot easier to argue the facts of the situation;

"the assessor recorded that I walked 50m, I did but they have failed to document that I had to stop every 10m for a rest due to breathlessness"

than their opinions

"based on my observations of the claimant walking I believe that they can reliably walk more than 200m.
