Can't let Assessors lies win! was created by Jacey62
Well, the dreaded letter finally arrived and I have been taken out of the SG and in to the WRAG, which is just as I suspected from the attitude of the Assessor at my F2F, Her report was very unfavourable. She has blatantly told lies in her report!. For example: 1) She said I coped well throughout the interview -Lie, I was distressed and cried through most of it -True... 2) Said my appearance was well kept and I was well groomed-Lie, I kept my big coat on throughout and wore my tatty Crocs which are comfortable, my hair needed washing, I was pale, drawn and had red blotches on my face-True..... 3) Said I was able to sit still throughout the interview-Big lie! , I constantly changed position as was uncomfortable and had to stand up on a number of occasions -True....4) Said my neighbour comes round and we sit and chat for hours-Lie, My neighbour occasionally comes round, only if I'm feeling up to it, and she will sit on one settee, and I will have my legs up, leaning on cushions on the other settee-True...%) Said Appeared to hear name when called in waiting room-Lie, My sister-in-law had to tell me my name had just been called as I was in anxious state- True........... The list is much longer !!

I have been so ill since the letter arrived, I have been to the Doctors a number of times, my anxiety has increased and I have developed further illnesses, I am now awaiting an X-ray and a Scan. I had made my mind up I couldn't go through all this again and that simply being on ESA is having a bad impact on my overall health. I was just going to come off it, but then how would I survive, I can't work so what would happen to me! I feel a bit stronger today and my family have told me I should fight it, as why let that horrible woman who saw me for one hour, (and being paid lots of money) result in me giving up something I am worthy of.

My Doctor has said If I decide to request a Mandatory Reconsideration, she can get a letter done, but it could cost £20-40, which I haven't got. What are the chances of a reconsideration if I get CAB to help me and just write and complain pointing out the impact on my mental and physical health that this has had and that the Assessor has not been truthful?? I have 10 days left to put the request in. Any advise would be appreciated.

Many thanks

Revision rates at MR are not very good although they tend to be better if you can get help from a trained advisor. The rates at appeal are significantly higher.

The issues you raise with the report are not winning ones if you will forgive me, they will simply be seen as "he says, she says", you need to confirm your problems by referencing the evidence you sent with your ESA50 and your testimony in it.
