Hi I was moved from incapacity benefit to contributory Esa years ago and have always been in the support group and I also claim Dla.
I was talking to someone in the same situation as me who receives £60 a week more esa than me and also can have free prescriptions. After some googling I found he must be claiming income related Esa and receiving the disability premium which I would be entitled to.
My question is can I claim the disability premium while on contributory based esa or can I change to claiming income related esa?

You may be eligible for a ESA(IR) top-up to your ESA(CB). ESA(IR) is dependant on your household income, your savings and assets, and any hours that your partner works. See

24 hour work rule for ESA(IR)

The DWP have asked claimants not to contact them about any back payments that they might be entitled but I would ignore this and request an ESA3 form which captures information about your financial situation.

Thanks for the reply Gordon. Ive been to the citizens advice and now received an ESA3 form and also a IS10 form to claim severe disability premium with my ESA. The DWP said it does look like I am one of the 70000 people underpaid ESA and it will take up to a year to find out if I will get this backdated to 2014. Before I got DLA money was so tight on ESA I wasnt able to put heating on and would spend winter under a duvet on the sofa so im grateful I found this site.
My question is when I complete the ESA3 form it asks if my illness or disability has changed, do I check no? I had an ESA medical last year and im in the support group. Also it asks for details of the Doctor who signs my statements for fitness for work, do I put my normal GP?

If your conditions haven't changed then tick "no" and supply your GPs address.

Thanks again. There's one last question on the esa3 form I'm not sure of.. It asks what date I would like the claim to be looked at again. Since it's never been right what date do you suggest to put on the form?

I would date it from the first day that you had ESA and DLA together, if this was when you were transferred from IB then that date.
