Where an ESA claim has been turned down and there is a time lag between the initial application and the decision can a claim for backdated JSA be made even though whilst waiting on the ESA decision the claimant was not actively seeking work? C
In case you are not aware, your real name appears to be showing in the forum, if you want to change this then follow the instructions in the following FAQ
Providing you can claim JSA and not Universal Credit then it is possible to backdate the claim but it would b unusual for it to be allowed, you would have to show that there was a significant delay in you being notified about the ESA Decision to have any chance.
