Hi all,

i am a mental health support worker - I have a client who has reached the Upper Tribunal appeal stage for his ESA claim - it has again been turned down, and he has until 12th July to respond. he and I are very much out of our depth and he is struggling to find any welfare benefits advice in LB of Lambeth. The CAB adviser who supported with initial submission to the tribunal is absent.

I wondered if it would be possible to submit a letter saying he is unable to find representation to buy some time?

He needs advice about the way forward - whether it would be best to submit a fresh ESA claim - he understands his condition must have deteriorated to do so, but this process has seen to that!

I am googling solicitors in south London who deal with welfare benefits, but unsure if this is a viable option financially.

Any thoughts welcome

I'm afraid not having Representation is unlikely to be accepted as reason for delaying the process.

You say he has been turned down at what stage of the appeal is he? If they are at the initial stage of appealing to the original Judge then they do have the option of appealing directly to the UTT.

You may be able to find local advice by doing an internet search for "welfare advice" with their postcode, town or county.
