DLA to PIp was created by Marie
My partner was on DLA and was told to apply for pip. He was refused pip after F2F. He asked for MR and that was refused. His appeal he was also turned down. His representative suggested as he was now over 65 he should apply for Attendance Allowance. However, he just got a call from Attendance Allowance who strongly suggested ted he was better to reapply for Pip as he met the criteria. This is so confusing. The guy at Attendance Allowance has sent all paperwork back to PIp and they have received the paperwork on 28 June. Have you heard of this happening before..

If the PIP department accept the claim then I would pursue it but I will be surprised if they do so unless the date when your partner reaches State Retirement Age is later than their 65th birthday. SRA begins to increase past 65 later this year.

Other than the increase in qualifying age due to SRA I can see nothing in the legislation that allows a claim for PIP after what is called the "Prescribed Age" unless an award of PIP had been previously made, which appears not to be the case.

I find the whole thing so confusing he has good medical evidence from his doctor. The Attendance Allowance chap said my partner was under the age of 65 in 2013 and he had a DLA award during the 12 months period before he made his latest claim. Therefore this latest claim must be treated as a claim to PIP. Attendance Allowance said he has medical evidence from the doctor which backs up his claim. As I say it’s all very strange to me. He said my partner was flagged up as someone who should submit a new claim. Can you shed any light on this Gordon. Is this a case that due to his depression and mobility problems that are being looked at again by DWP he scored zero points

I'm afraid the 2013 date is only applies to transfers from DLA to PIP, this no longer applies as this is a new claim for PIP not a transfer.

As far as I can see the fact that they were claiming DLA in the last 12 months is also not relevant.

As I've said, if the claim is accepted then great I just don't think that it will.

I think once again Gordon we have been told a lot of lies. This is what they do. I really don’t know what we do if it’s refused waited nearly 3 months for attendance allowance to tell us this. Thanks You Gordon

If you have to revert to an AA claim, then you can argue that the date you originally contacted them should be the date of the claim.
