hi I am currently in the process of changing my sons DLA to PIP as he has reached that age of 16 due to alsorts of issues on the dwp end we finally got the appointee visit from the visiting officer the same day as out assessment from ATOS. The visiting officer spoke for half an hour with us about my son problems and had some time to talk to my son. She made me his appointee and gave me paperwork to show atos that afternoon. two hours later we has the assessment where my son was withdrawn and unsettled but generally well behaved. Two days after the assesmnent I requested the report and 10 days later it arrived. Well its a shambles and apparently his taking 2 GCSE's is a reason to refused most of the descriptors. he also marked as benig able to manage his own affairs in the reading and manging money sections. has anyone else had this occur the same day as a visiting officer said they needed help and spent longer with my son then the assessment did at 38 minutes

Your son needing an appointee is an important piece of evidence in regard to a PIP claim but it really only addresses Making Decisions About Money directly, you also have to take into account that the DWP person was making a general assessment where the assessor was looking at how your son meets the PIP Descriptors.

That said, it does not mean that the comments that the assessor has made are accurate or representative of the problems that your son has.

If want it, there is a narrow window where you can write to the Decision Maker with your concerns over the report, I would stick to issues that lead to points and I would make it clear, in the even that a Decision is made before your letter arrives, that it is not a request for an MR.

Thank you Gordon. He was turned down on every point due to his gcse’s And his ownership of a Nokia 3310 basic phone. I spoke to dwp and they have put a note on the file that I was sending further evidence before the decision is made hopefully this will work. My MP has requested the national insurance details and date of birth of my son also so he can follow up. My son has frontal lobe problems due to damage which occurred due to meningitis. He also has adhd as a diagnosis with traits of autism. He took these gcse’s In his special school with added time and the results could be anything from a d downwards. His head wrote a note to back this up so I have sent this in as evidence together with a detailed report we had when he was diagnosed aged 8. I found his mobile usage statements that show he only uses a max of 5 minutes a months in calls and 4 or 5 texts. With some months showing no usage. I did discuss all this with the atos hp but he left it all out in the report.

Don't just respond to the assessment report, understand the point that the assessor is trying to make so that you can target your arguments against it.

For example; PIP does not consider the use of a mobile phone, so in general terms it matters not whether the claimant has one or not, how often they use it and what kind of phone it is, so what opinion are they trying to put forward?

But the assessor was saying that social history shows he’s a mobile phone user so can communicate. In his evidence on the report he mentions that he saw my son using a mobile phone which he didn’t he only saw he had the mobile. The report was missing large parts of the conversation about his gcses and the phone. My son performed terribly at the 7’a test and was asked on two occasions to try again with another answer even after taking a long time answering in the first place. The three words test he asked my son to remember the words then asked me further questions and then asked him the words. He had been trying so hard to remember but could only remember two.

When I had my assessment the assessor gave me nil for everything....she said that as I was working in an office 2 years ago I could 'sequence' and do all the descriptors. She also said I could do complex money decsions as I ordered stuff online....this was despite medical evidence that I had wasted thousands of pounds due to manic bi polar issues..

At MR I was given 11 points for D L and 8 for mobility....as the moderators always say you will have to say how your son's illnesses prevent him from doing the descriptors....though I have tyo say how anybody under 18 can be classed as being able to make complex budgetary decisions is beyond me
