Hi, It is time for me to complete my ESA50 form. Last time I needed to go to a tribunal before I was granted ESA. When completing the form I was wondering whether I should include references to how I coped (or didn't) with Jobcentre interviews and the tribunal experience last time around.( I suffer from anxiety issues) My concerns are that if I make them aware that I was taken all the way to a tribunal last time that they may disallow my initial claim and force me to appeal again hoping that I will lose the tribunal hearing this time. If they are already aware of my history I believe that by making these references to interviews etc. that it is a good way for me to express my condition. Hope this makes sense! Any advice please?
Those assessing you will do so on the merits of your claim, they won't be concerned with how your current award was achieved.
You can include what you with your ESA50 if you think that it will assist with your claim, the Decision Notice from your Tribunal will definitely help providing you can show that it is still relevant to your conditions and limitations as they now are.
