PIP Decision Letter was created by bytespc
Well it arrived this morning and they've awarded me Standard Rate for Daily Living but Lower Rate for Mobility, previously on lower rate for daily and higher rate for mobility which is a loss of £127.40 a year and free car tax / car etc so my question is should I ask for a mandatory reconsideration or let sleeping dogs lie...I'm so stressed by all this and I really don't know what to do.

I'm afraid this is a decision that only you can make!

Understand that the criteria for PIP are significantly more strict than it's DLA equivalent so an HRM award translates into a Standard award for PIP unless you show that you are more limited now.


If you decide to then the first stage to challenging a Decision is for you to request a Mandatory Reconsideration, this needs to be done in writing to the DWP, within one month of the Decision, to the office that dealt with your claim, have a look at our PIP MR & Appeal guide for details of the process, the PIP area also has template letters that you can use to make the request with.

You should contact the DWP for a copy of the assessment report if you have not already done so, I would phone them but again follow up the request in writing. Once you have the assessment report you will have a better understanding of how the DWP Decision Maker has come to their conclusions and will then be able to argue against them.

Your primary task is to show that you meet the criteria, there are many reasons you may have failed, you need to address each of these but don't get bogged down in criticising the assessment report unless you can clearly show that it is incorrect, it is a lot easier to argue the facts of the situation;

"the assessor recorded that I walked 50m, I did but they have failed to document that I had to stop every 10m for a rest due to breathlessness"

than their opinions

"based on my observations of the claimant walking I believe that they can reliably walk more than 200m.

Thanks for your prompt reply the assessment report was included in the decision letter and the main things that irk me greatly is f2f stated we weren't upset by the process ( I sobbed like a child at the humiliation of it all ) also a main plank of my losing the car would appear to be that I can drive a manual vehicle , now as this is in no way a question or descriptor plus or minus how the hell can they keep shifting the goal posts, also they observed me struggling to walk less than 15 yards to the door but magically she states that I can walk just below the threshold for 12 points ie more that 20 less than 50....it's so obviously a tick box exercise to reduce the thousands I could claim in car maintenance / insurance / tax etc but magically I still have enough points to warrant a blue badge ….because I've deteriorated

Also my award is for 3 years retest in 2 because all my conditions will deteriorate , it actually says that in the decision letter, also whilst all this was going on I was being told by a hernia surgeon that my hernias are inoperable because the heart specialist stated in his recent review that my heart is now so badly damaged I wouldn't survive the surgery so I have to make do with palliative care ( nothing they can do but manage my symptoms then I die ) .
