Hello,

I hope you can help me, I was on higher rate care and mobility DLA, both have been reduced to the lower rate after my PIP assessment.
I have decided to appeal and have the Mandatory reconsideration form, but I don’t know how much of the PIP report I should challenge and how.
I recorded my assessment with permission, I know I didn’t perform well, It went on for a very long time and I was rambling, before I could finish answering a question, I was asked another sometimes unrelated question, still, the report barely resembles the actual assessment.
The report claims, I said I could walk for 3 minutes, when I had said I couldn’t walk any distance without severe pain, breathlessness and exhaustion, I explained how I need to hold on to a wall for balance when walking just a few steps. It goes into great detail about the skills, concentration, coordination etc I use to drive a manual car, when I had said I can no longer drive a manual car and only occasionally drive my automatic car very short distances to the GP etc. It says I can prepare a simple meal, when I had said I can’t and haven’t been able to for over 10 years. During the assessment I became very breathless and used my Ventolin, yet the report says I didn’t need to use Ventolin. Most of the report goes on in this way.
These inaccuracies to put it mildly are plain to hear on the recording of which they have a copy, I don’t know how to challenge it, do I point out every lie? if so how should I word it, or should I just ask them to listen to the recording and look again at my claim form?

What form di you complete for the reassessment, an AR1 Review form or another PIP2?

Dealing with the assessment report is important but is unlikely to result in the Decision being revised, deal with the issues that directly lead to your scoring points and specifically do not deal with those that are trivial such as spelling mistakes or grammar.

In addition, you need to go back through your claim form to make sure that you have explained how and why you meet the criteria for your previous award. Reliability and on the majority of days still apply.

Thanks for your reply,

I filled in the PIP2 form this was a change over from DLA to PIP
I now have the CRMR1 form to request a Mandatory reconsideration, I hope this is the right one.

There is no required form for requesting an MR, a letter or even a phone call will do although we do not recommend the latter.

OK, thanks Gordon,

should I mention the recording and that it proves the report to be wrong?
or should I challenge each point as inaccurate, also should I say how many points I believe I should have received?

You can mention the recording for the MR but the assessor is not going to listen to it.

As I said in my previous post, deal with the issues that lead to points but understand an award will only be made by your showing that you meet the criteria for one.
