Some recovery made, will they inquire? was created by Dashiell
I have just received form ESA50, my first reassessment in six years. In 2012 I was very ill, had difficulty looking after myself, going out or meeting people, all for mental health reasons. Back then I was placed in the Support group without a face-to-face interview. With a lot of thanks to your wonderful website. Since that time I have made a great deal of progress, partly due to going to a good day centre (at first very occasionally, but more often in recent years) and partly due to a couple of good therapists. Some of my self confidence has returned and I am beginning to form relationships again, though very tentatively. I also, due both to to my illness and medication, have a very short (about half an hour) concentration span. I can go outside now and shop and clean.
Now my problem is that I should probably have been reassessed a couple of years ago, with me having declared a change of circumstances, but I kept putting it off fearing a relapse. So my question is, will the ESA try to claim any money back, go into my bank accounts etc if I now make a claim that shows I am much better compared to the situation six years ago?
Thanks for your help.

Unless there is some specific point in your medical history where it is clear that you no longer met the requirements for the Support Group, then I would be very surprised if there was any attempt to recover your ESA payments, however, you must tell the DWP of any future improvement of your conditions that would result in a potential change of award.

There has been at least one major change to the criteria since you were last assessed and numerous changes to the DWP guidance so any reduction in your award may be the result of these rather than an improvement in your conditions.

Do you know how you qualified for the SG last time you were assessed?

Sorry for the delay in replying Gordon, and thanks for the advice. My award letter in 2012 said my ESA was being calculated as

Your living expenses. £71.00
Extra money because you are severely disabled £58.20
Extra money because of the Disability Income Guarantee. £14.80

Extra money because you are in the Support Group. £34.05
Which gives a total income-related amount. £178.05

They didn’t give details of the points awarded for the various sections of the ESA form.
But I definitely won’t get this amount awarded this time. I think I’ll be lucky to get into the WRAG.

If you are unsure whether you would now even qualify for an award, then you should have told them about the improvements in your health, whilst I still don't think that any money will be recovered, it will raise issues as to when this actually happened.

Hi Gordon

The recovery has happened in the last nine months, as a result of seeing a very good therapist who helped me see that the voices I hear come from a few specific traumas in my past, and weren’t necessarily anything to do with what is happening to me now. She taught me to form a distance from them so that they don’t interfere so alarmingly in my present day activities. They are still there, they stil interfere, but I can function better. I had a relapse in 2016 (when I was seen by the local crisis team) and another one last summer, so it was a while before I began to trust that the improvement was lasting. I still don’t wholly believe that it is.

As for getting into the WRAG, I’m feeling a bit more optimistic today, when I consider my fellow service users at my day centre who are in both the SG and WRAG. They don’t seem so much worse in their day to day activities than I am, so if they can do it I can.

Thanks,
